An insurer’s subrogation right is quasi-contractual. Notice must be sent to the insured, unequivocally stating the insurer is exercising these rights. Furthermore, if the insurer does not meaningfully participate in the suit, the Common Fund Doctrine may bar the insurer from recovery.
